PRE HEADING TEXTStanding Up For Your Rights
The National Association of Local Boards of Health lists the following as potential results of concentrated animal farming operations (CAFOs):
- Contaminated groundwater
- Polluted surface water
- Accidental releases of manure
- Reduced air quality because of the odor emanating from concentrated manure
- Emissions of various kinds of harmful particulates
- Noxious odors
- Increase of flies and mosquitos
- Pathogens that can cause disease or infection
While AFOs are regulated by the US Environmental Protection Agency and the Texas Commission on Environmental Quality, this may not prevent an AFO from harming your property or home. Read more below to explore your legal options.
Trespass Actions
If you can prove an entry or intrusion without permission from the property’s owner, like if a neighboring farm releases manure or liquid onto your property, you may be able to prove a trespass claim.
Toxic Torts and Federal Law Violations
If you have been exposed to a harmful or toxic substance like a pesticide, pharmaceuticals, or other chemical substance, you may have a toxic tort case. Groundwater contamination is an example of a violation that counts as a toxic tort case.
